Refund Policy: By commissioning work by Thompson InkWorks, the client acknowledges that fees are for personalized services and as such are non-refundable.

Payments, Milestones and Statements of Work: In general, full payment is usually required for small projects estimated at $250 or less before work commences. A simple agreement to proceed and an arrangement for payment are all that are usually required for smaller projects to begin work. Larger projects (estimated at more than $250) usually require 33.33% to 50% initial payment with one ore more payments as the project work meets agreed upon milestones. A typical project with two milestones might work out to something similar to this:

50% initial payment billed at Project Inception
25% billed upon completion of Milestone One
25% billed upon completion of Milestone Two or Project Completion

The number and nature of project milestones, if any, will be discussed and ultimately agreed upon by both the client and Thompson InkWorks. A Statement of Work which spells out the particulars of the project in terms of payments, milestones, responsibilities and other details will be provided that requires the signatures of both the client and a representative of Thompson InkWorks. The Statement of Work will function as a legally binding contract between the client and Thompson InkWorks and is designed to clarify the nature and scope of all project work as well as to protect both client and provider.

If a client decides to discontinue use of the services they have commissioned for any reason the client will be billed for the amount of time spent on their order prior and up to the time of cancellation. This includes the information gathering session and any telephone calls, briefings, e-mails or facsimiles. Notification of this decision is the responsibility of the client and monies for time spent on their behalf up to this notification becomes immediately payable. Failure by the client to notify Thompson InkWorks of their decision will not negate payment in full. The rate charged prior to the provision of the first draft is $55 per hour pro-rata.

Timeliness: After the client supplies the appropriate information, Thompson InkWorks will provide an estimated date when the first draft will become available for the client's review, feedback and correction. In the case of larger projects, this may take the form of a Statemnt of Work rather than a simple verbal agreement to proceed. All work will be completed in a timely manner subject to acts of God, equipment failure, or other circumstances beyond Thompson InkWorks's control.

Deadline for Completion: Each client is hereby advised that failure of the client to respond within 10 days of the receipt of this first draft will be considered as a termination of the commissioning contract and no further work will be performed on his or her behalf. Thompson InkWorks requires that projects be completed within 30 days from the initial consultation. After 30 days if the client fails to request an extension of time Thompson InkWorks will consider the project finished. Further consultation time or revisions will be subject to fees.

Pricing: Thompson InkWorks advises that estimates and prices are good for 60 days from the time of order placement. Current prices apply if an order is "shelved" and resumed after 60 days.

Use of Style Guides and Templates: Thompson InkWorks will work with the client's in-house style guides and design templates if given. Otherwise, Thompson InkWorks retains the right to choose appropriate content and design styles according to the project particulars.

Intellectual Property Rights: Unless otherwise specified, the client retains intellectual property ownership of all work produced with one exception: for the purposes of portfolio representation only, Thompson InkWorks retains the right to use the name or other designation of the client and client's customers as well as small sample clips, testimonials or similar materials generated in the course of the project. Clients are permitted to reproduce additional copies via facsimile, scanner, printer or photocopier and can alter their own documents. As a professional courtesy, clients are asked to attribute project materials to Thompson InkWorks as appropriate and to endeavor to retain the high standards of writing, editing and content design that go into each project undertaken by Thompson InkWorks.

Confidentiality: Thompson InkWorks respects the right to confidentiality for all visitors to our site and for all clients. Under no circumstances will Thompson InkWorks divulge details about our site visitors, or discuss client details or other project particulars with other clients relating to specific projects.

Error Introduction Disclaimer: Thompson InkWorks assumes no responisbility for errors or modications made to the project material after completion. Clients are responsible for all inaccuracies in style, grammar, spelling, structure, formatting, or other content particulars after project completion.

Liability Disclaimer: Thompson InkWorks is not liable for information obtained from a client that is inaccurate or incorrect. Thompson InkWorks does not research or investigate any information given by the client and assumes the client has been truthful in all areas. Thompson InkWorks's liability is limited to completion of work and assumes no liability after the work has been accepted as complete.

Client Responsibility: It is the responsibility of the client and indeed in the client's best interests, to supply Thompson InkWorks with all requested information and to work collaboratively to complete a custom package that reflects the messaging, desired format, overall scope and project goals for each assignment undertaken on the client's behalf. Thompson InkWorks strongly encourages active client participation and clear communications in this process to achieve the best outcome possible for all concerned.
